Railroad Safety Improvement Act of 2008

On January 16, 2009 ACRE officials in tandem with the Coalition of Unions representing
other crafts on Metro-North met with OSHA Supervisory Investigator Michael Mabee.
Mr. Mabee described in detail the protections now granted to railroad employees under
the Federal Rail Safety Act (FRSA) concerning work related injuries and illnesses. The
railroad industry nationwide has been using questionable tactics in their quest to absolve
themselves of any wrong doing when an on the job injury or illness occurs. Mr. Mabee
explained that under FRSA, railroad employees can now report railroad carriers who
harass or unfairly discipline workers injured while on duty. Railroad carriers found in
violation of FRSA can now be subject to fines of up to $250,000.
